1. Estos Términos y Condiciones de Uso regulan las reglas a que se sujeta la utilización de la APP CONTROL DE HORAS (en adelante, la APP), que puede descargarse desde Google Play y UpToDown. La descarga o utilización de la APP atribuye la condición de Usuario a quien lo haga e implica la aceptación de todas las condiciones incluidas en este documento y en la Política de Privacidad. El Usuario debería leer estas condiciones cada vez que utilice la APP, ya que podrían ser modificadas en lo sucesivo.
2. La aplicación es de libre acceso a través de las tiendas anteriormente indicadas. Cualquier persona podrá acceder a la descarga y uso de la APP.
3. Uso de la APP: La app consiste es gestionar las horas trabajadas y dedicadas a cualquier tarea por una persona o usuario. Será el propio usuario el que indicará la hora de entrada, la hora de salida, el turno de trabajo, los tipos de horas y cantidad de horas que se ha trabajado. Es importante remarcar que cada tipo de hora lleva asociado un precio.
4. La publicidad que se muestra a través de la APP es responsabilidad de APPTITUDE CODE, S.L.U., informando y dando la posibilidad al usuario de que la primera vez que entre en la APP puede seleccionar entre anuncios personalizados y no personalizados. 5. Cargos: eres responsable del pago de todos los costes o gastos en los que incurras como resultado de descargar y usar la Aplicación de APPTITUDE CODE, S.L.U. incluido cualquier cargo de red de operador o itinerancia. Consulta con tu proveedor de servicios los detalles al respecto.
6. Estadísticas anónimas: APPTITUDE CODE, S.L.U. se reserva el derecho a realizar un seguimiento de tu actividad en la Aplicación y a informar de ello a nuestros proveedores de servicios estadísticos (terceros). Todo ello de forma anónima. Utilizamos Google Analytics y Firebase Analytics.
7. Protección de tu información personal: queremos ayudarte a llevar a cabo todos los pasos necesarios para proteger tu privacidad e información. Consulta la Política de privacidad de CONTROL DE HORAS para conocer qué tipo de información recopilamos y las medidas que tomamos para proteger tu información personal. Se podrá enviar notificaciones a los usuarios. Los usuarios pueden deshabilitar o habilitar las notificaciones desde la configuración de su terminal Android.
8. Queda prohibido alterar o modificar ninguna parte de la APP a de los contenidas de la misma, eludir, desactivar o manipular de cualquier otra forma (o tratar de eludir, desactivar o manipular) las funciones de seguridad u otras funciones del programa y utilizar la APP o sus contenidos para un fin comercial o publicitario. Queda prohibido el uso de la APP con la finalidad de lesionar bienes, derechos o intereses de APPTITUDE CODE, S.L.U. o de terceros. Queda igualmente prohibido realizar cualquier otro uso que altere, dañe o inutilice las redes, servidores, equipos, productos y programas informáticos de APPTITUDE CODE, S.L.U. o de terceros.
9. La APP y sus contenidos (textos, fotografías, gráficos, imágenes, tecnología, software, links, contenidos, diseño gráfico, código fuente, etc.), así como las marcas y demás signos distintivos son propiedad de APPTITUDE CODE, S.L.U. o de terceros, no adquiriendo el Usuario ningún derecho sobre ellos por el mero uso de la APP. El Usuario, deberá abstenerse de:
a. Reproducir, copiar, distribuir, poner a disposición de terceros, comunicar públicamente, transformar o modificar la APP o sus contenidos, salvo en los casos contemplados en la ley o expresamente autorizados por APPTITUDE CODE, S.L.U. o por el titular de dichos derechos.
b. Reproducir o copiar para uso privado la APP o sus contenidos, así como comunicarlos públicamente o ponerlos a disposición de terceros cuando ello conlleve su reproducción.
c. Extraer o reutilizar todo o parte sustancial de los contenidos integrantes de la APP.
10. Con sujeción a las condiciones establecidas en el apartado anterior, APPTITUDE CODE, S.L.U. concede al Usuario una licencia de uso de la APP, no exclusiva, gratuita, para uso personal, a nivel internacional y con carácter indefinido. Dicha licencia se concede también en los mismos términos con respecto a las actualizaciones y mejoras que se realizasen en la aplicación. Dichas licencias de uso podrán ser revocadas APPTITUDE CODE, S.L.U. unilateralmente en cualquier momento, mediante la mera notificación al Usuario.
11. Corresponde al Usuario, en todo caso, disponer de herramientas adecuadas para la detección y desinfección de programas maliciosos o cualquier otro elemento informático dañino. APPTITUDE CODE, S.L.U. no se responsabiliza de los daños producidos a equipos informáticos durante el uso de la APP. Igualmente, APPTITUDE CODE, S.L.U. no será responsable de los daños producidos a los Usuarios cuando dichos daños tengan su origen en fallos o desconexiones en las redes de telecomunicaciones que interrumpan el servicio.
12. IMPORTANTE: Podemos, sin que esto suponga ninguna obligación contigo, modificar estas Condiciones de uso sin avisar en cualquier momento. Si continúas utilizando la aplicación una vez realizada cualquier modificación en estas Condiciones de uso, esa utilización continuada constituirá la aceptación por tu parte de tales modificaciones. Si no aceptas estas condiciones de uso ni aceptas quedar sujeto a ellas, no debes utilizar la aplicación ni descargar o utilizar cualquier software relacionado. El uso que hagas de la aplicación queda bajo tu única responsabilidad. No tenemos responsabilidad alguna por la eliminación o la incapacidad de almacenar o trasmitir cualquier contenido u otra información mantenida o trasmitida por la aplicación. No somos responsables de la precisión o la fiabilidad de cualquier información o consejo trasmitidos a través de la aplicación. Podemos, en cualquier momento, limitar o interrumpir tu uso a nuestra única discreción. Hasta el máximo que permite la ley, en ningún caso seremos responsables por cualquier pérdida o daño relacionados.
13. El Usuario se compromete a hacer un uso correcto de la APP, de conformidad con la Ley, con los presentes Términos y Condiciones de Uso y con las demás reglamentos e instrucciones que, en su caso, pudieran ser de aplicación El Usuario responderá frente a APPTITUDE CODE, S.L.U. y frente a terceros de cualesquiera daños o perjuicios que pudieran causarse por incumplimiento de estas obligaciones.
14. Estos Términos y Condiciones de Uso se rigen íntegramente por la legislación española. Para la resolución de cualquier conflicto relativo a su interpretación o aplicación, el Usuario se somete expresamente a la jurisdicción de los tribunales de GRANADA (España).
1. These Terms and Conditions of Use govern the rules to which the use of the APP TIME CONTROL (hereinafter, the APP), which can be downloaded from Google Play and UpToDown. The download or use of the APP attributes the condition of User to whoever does it and implies the acceptance of all the conditions included in this document and in the Privacy Policy. The User should read these conditions each time he/she uses the APP, as they may be modified from time to time.
2. The application is freely accessible through the stores listed above. Anyone can access the download and use of the APP.
3. Use of the APP: The app deals with the managing of hours worked and dedicated to any task by a person or user. It will be the user himself the one that will indicate the hour of entry, the hour of exit, the shift of work, the types of hours and quantity of hours that has been worked. It is important to note that each type of hour has a price associated with it
4. The advertising shown through the APP is the responsibility of APPTITUDE CODE, S.L.U., informing and giving the user the possibility that the first time he uses the APP he can select between personalised and non-personalised advertisements. 5. Charges: You are responsible for the payment of all costs or expenses incurred as a result of downloading and using the APPTITUDE CODE, S.L.U. Application including any operator network or roaming charges. Check with your service provider for details.
6. Anonymous statistics: APPTITUDE CODE, S.L.U. reserves the right to monitor your activity using the Application and to inform our providers of statistical services (third parties). All this anonymously. We use Google Analytics and Firebase Analytics.
7. Protection of your personal information: We want to help you take all the steps necessary to protect your privacy and information. Please refer to the TIME CONTROL Privacy Policy to know what information we collect and the steps we take to protect your personal information. Notifications may be sent to users. Users can disable or enable notifications from their Android terminal settings.
8. It is prohibited to alter or modify any part of the APP or its contents, to circumvent, deactivate or otherwise manipulate (or attempt to circumvent, deactivate or manipulate) the security or other functions of the program and to use the PPP or its contents for a commercial or advertising purpose. It is forbidden to use of the APP for the purpose of damaging property, rights or interests of APPTITUDE CODE, S.L.U. or third parties. It is also forbidden to make any other use that alters, damages or disables the networks, servers, equipment, products and software of APPTITUDE CODE, S.L.U. or third parties.
9. The APP and its contents (texts, photographs, graphics, images, technology, software, links, contents, graphic design, source code, etc.), as well as trademarks and other distinctive signs are the property of APPTITUDE CODE, S.L.U. or third parties. Users do not acquire any right over them by the simple use of the APP. The User must abstain from:
a. Reproducing, copying, distributing, making available to third parties, publicly communicating, transforming or modifying the APP or its contents, except in the cases contemplated by law or expressly authorised by APPTITUDE CODE, S.L.U. or by the holder of the mentioned rights.
b. Reproducing or copying for private use the APP or its contents, as well as communicating them publicly or making them available to third parties when this entails their reproduction.
c. Extract or reuse all or a substantial part of the contents of the APP.
10. Subject to the conditions established in the previous section, APPTITUDE CODE, S.L.U. grants the User a non-exclusive, free licence to use the APP for personal, international and indefinite use. This license is also granted on the same terms with respect to updates and improvements made in the application. These licenses may be revoked by APPTITUDE CODE, S.L.U. unilaterally at any time, by simply notifying the User.
11. It is User responsability, in any case, to have adequate tools for the detection and disinfection of malicious programs or any other harmful computer element. APPTITUDE CODE, S.L.U. is not responsible for damages caused to computer equipment during the use of the APP. Likewise, APPTITUDE CODE, S.L.U. shall not be liable for damages caused to Users when such damages are caused by failures or disconnections in telecommunications networks that interrupt the service.
12. IMPORTANT: We may, without any obligation to you, modify these Terms of Use without notifying then at any time. If you continue to use the application after any modification has been made to these Terms of Use, such continued use shall constitute your acceptance of such modifications. If you do not accept these Terms of Use or agree to be bound by them, you must not use the application nor download it nor use any related software. Your use of the application is at your sole risk. We have no responsibility for the deletion or inability to store or transmit any content or any other information maintained or transmitted by the application. We are not responsible for the accuracy or reliability of any information or advice transmitted through the application. We may, at any time, limit or discontinue your use at our sole discretion. To the fullest extent permitted by law, in no event will we be liable for any related loss or damage.
13. The User undertakes to make correct use of the APP, in accordance with the Law, with these Terms and Conditions of Use and with any other regulations and instructions that may be applicable. The User shall be liable to APPTITUDE CODE, S.L.U. and to third parties for any damages that may be caused by breach of these obligations.
14. These Terms and Conditions of Use are governed entirely by Spanish law. For the resolution of any conflict relating to its interpretation or application, the User expressly submits to the jurisdiction of the courts of GRANADA (Spain).
